8.0 CONSULTANCY THROUGH THE UNIVERSITY AND OTHER EXTERNAL ENGAGEMENTS

The University encourages the faculty’s professional growth and other engagements beyond the ambit of the academe. As the national university, UP is mandated to harness the expertise of the members of its community and other individuals to study the state of the nation regularly in relation to its quest for national development, identify key concerns, formulate responsive policies regarding these concerns, and give advice and recommendations to Congress and the President of the Philippines. [Republic Act No. 9500 (23 July 2007), Sec. 7] In pursuit of this commitment, UP leads as a public service university by providing various forms of community, public, and volunteer service, as well as scholarly and technical assistance to the government, the private sector, and civil society while maintaining its standards of excellence. [Rep. Act No. 9500, Sec. 3d]

External engagements or outside activities are the faculty member’s professional services provided for the benefit of institutions, agencies, and organizations outside of the University through friendship, volunteer work, or in return for some sort of compensation. The University recognizes that these external engagements can enhance teaching by validating the faculty member’s teaching and research within real-world situations. In addition, these activities can help the University establish linkages with industry and with organizations, which can benefit the students and wider University community.

Although the University recognizes the advantages of these engagements, the faculty’s consultancy work, commissioned research or creative work, practice of profession, and other forms of external engagements must be disclosed to, and supervised by, the Universityto to (a) ensure that the auxiliary external engagements do not interfere with the faculty member’s institutional obligations; (b) protect the rights of the faculty members, REPS and administrative staff, and students; and (c) prevent possible “conflicts of interest” that compromise the University’s academic freedom, intellectual principles, and ethical standards. The Office for the Advancement of Teaching (OAT), under the Office of the Vice Chancellor for Academic Affairs (OVCAA), and the Office of Extension Coordination (OEC), under the Office of the Vice Chancellor for Research and Development (OVCRD), are tasked to monitor the external engagements of the UP Diliman faculty.

  • 8.1 CATEGORIES OF EXTERNAL ENGAGEMENTS

    External engagements or outside activities of University personnel include: (a) outside consultancy work; (b) the limited practice of profession; (c) commissioned research, creative work and other activities or projects under the auspices of outside agencies; (d) teaching in other educational or training institutions with which the University has a Memorandum of Agreement; (e) management of private enterprises; (f) secondment; and (g) other engagements that are not considered integral functions of the University. Such activities are not considered part of the regular workload of the faculty unless authorized by University officials concerned. [987th UP BOR Meeting (24 April 1986)]

    The University encourages the faculty’s full freedom in research and creative work, and in the publication of results of these endeavors, subject to the faculty members’ adequate performance of their other academic duties.     • 8.1.1 Consultancy Work / Services

      Consultancy work refers to activities in which faculty members draw upon their professional academic expertise to provide advice and services, for which they receive compensation, to benefit organizations outside the scholarly community. Consultancy work is considered a logical application of one’s professional and scholarly expertise outside the academic institution and extension of the faculty’s role and responsibilities. [Boyer and Lewis (1984), p. 638]

      There are two categories of faculty consultancy work: [987th UP BOR Meeting (24 April 1986)]

      9.1.1.1

      Institutional consultancy work is an engagement or work acquired through the University, covered by a Memorandum of Agreement (MOA) with UP Diliman.

      9.1.1.2

      Independent consultancy work is an engagement or work acquired as a professional in one's field of expertise, provided such is reported/ disclosed to the University and approved by the proper body.

    • 8.1.2 Limited Practice of Profession

      Faculty members may engage in private practice of the profession provided such private practice may enhance their usefulness to the University or improve their efficiency. [The Revised Code of the University of the Philippines (1961), Art. 252]

    • 8.1.3 Commissioned Research and Creative Work

      External agencies and organizations can directly commission or fund faculty members’ research projects and creative work projects or performances, subject to existing University policies. 

    • 8.1.4 Teaching in Other Educational or Training Institutions

      In line with its leadership role in higher education, the University may allow some faculty members to teach in other educational or training institutions, subject to guidelines set by the Board of Regents.

    • 8.1.5 Management of Private Enterprises

      University personnel are restricted from personally managing a private enterprise which in any way may be affected by the functions of their office. [The Revised Code of the University of the Philippines (1961), Art. 250]

    • 8.1.6 Secondment

      Upon request of another agency, government or private, and when the needs of the University so permit, University personnel may be detailed by secondment to a requesting agency, subject to University policy. [987th UP BOR Meeting (24 April 1986)] Secondment refers to the temporary transfer of an official or worker to another position or employment for a defined period of time, for a specific purpose. (See the Guidelines on Secondment in Chapter 17 of this Manual).

    • 8.1.7 Other Types of External Engagements

      9.1.7.1

      University personnel may, subject to the exigencies of service, and with permission of the Dean of the college or head of office, accept speaking and similar engagements on official time. [978th UP BOR Meeting (24 April 1986)]

      9.1.7.2

      As general rule, members of the faculty as well as the administrative staff are enjoined to be part of professional organizations. [OVPA Memorandum No. 31 (28 March 2001)]

      9.1.7.3

      University faculty and staff are prohibited from participating in the conduct of review classes for entrance/qualifying exams to the University. [Office of the Chancellor Memorandum No. ERR-00-131 (12 September 2000) (See also Chapter 18, Sec. 18.2.8)

       

  • 8.2 GENERAL GUIDELINES ON FACULTY EXTERNAL ENGAGEMENTS

    Although the University recognizes the benefits of external engagements to the faculty and the University, such are conducted in accordance with the following general guidelines:

    • 8.2.1 Prior Authorization

      University personnel are not allowed to engage in outside activities or external engagements without prior authorization from the Chancellor. Engagement in external activities should be endorsed by the Dean, Director, or head of office concerned, subject to the exigencies of the service.     • 8.2.2 Work Scope and Coverage

      Except as otherwise provided for in these rules, permission to engage in outside activities or external engagements is for a period not exceeding one (1) year, renewable for the same period at the discretion of the Chancellor, upon recommendation of the Dean, Director or head of office concerned. Such permission may be terminated or withdrawn at any time by the Chancellor. [987th UP BOR Meeting (24 April 1986)]

    • 8.2.3 Reports and Disclosures

      Any person authorized under these rules to be involved in outside activities or external engagements are expected to make periodic reports on and full disclosure of such activities, through channels, to the Chancellor. [987th UP BOR Meeting (24 April 1986)]

    • 8.2.4 Use of University Time and Resources

      9.2.4.1

      External engagements, acquired through independent means, must not be accomplished during official work hours in the University. Faculty members should abstain from using University resources for external engagements not authorized by the University.

      9.2.4.2

      University resources should be used for University purposes and not for personal gain or personal commercial advantage, nor for any other non-University purposes.

      9.2.4.3

      Under the University’s IPR policy, inventions that use substantial University resources are owned by the University.

      9.2.4.4

      However, the University subscribes to a policy of recognizing the traditional academic practice of treating faculty members as owners of inventions, works and other intellectual creations that they produce without the use of University and/or third party funding, and without the use of substantial University and/or third party resources.     • 8.2.5 On the Potential Conflict of interest

      Conflict of interest can arise in situations in which primary and secondary interests exist. The primary interests of faculty members and scholars are to pursue excellence in teaching, research and extension, and to work continuously towards advancing their knowledge and skills; to relate these activities to the needs of the Filipino people and their aspirations for social progress and transformation; and to keep academic freedom inviolate in the performance of our roles as teachers and scholars with integrity, honesty, creativity, propriety, fairness, and devotion. [Rep. Act No. 9500, Sec. 8; UP Faculty Code of Ethics, approved at the 63rd University Council Meeting (08 December 1998) and noted at the 1128th UP BOR Meeting (28 January 1999)]

      Secondary interests are linked with obligations that arise in engagements with outside agencies and organizations. This set of interests could be a source of conflict of interest. Thus, faculty members are enjoined to exercise caution in engaging in activities and interests that interfere with their responsibilities as faculty members and that conflict with the interests of the University.     • 8.2.6 Penalties

      9.2.6.1

      Violations of any of the rules on outside activities or external engagements are grounds for disciplinary action. The immediate superior of the faculty/staff member will immediately submit a report on any violation of the rules to the Office of the Chancellor, through channels. Disciplinary action on any faculty/staff member may be imposed, but only in accordance with the law, and after due process. [1031st UP BOR Meeting (28 June 1990)]

      9.2.6.2

      Aside from penalties which may arise from the violation of any other law or University policy or guideline, any person found to have violated any of the provisions of the UP Intellectual Property Rights Policy in the conduct of external engagements will suffer the penalties contained therein.       9.2.6.2.1

      The faculty is rendered ineligible for research grants from the University or any of its affiliated foundations for a period not to exceed five years.

      9.2.6.2.2

      The faculty's research load credits are automatically removed, and the faculty is rendered ineligible to receive these benefits for a period not to exceed five years.

      9.2.6.2.3

      The faculty is removed from any University administrative position and is disqualified from any administrative position for a period not exceeding five years.

      9.2.6.2.4

      The faculty is rendered ineligible to engage in outside teaching activities or the privilege to engage in the practice of their profession for a period not exceeding five years is revoked.

       

  • 8.3 ADMINISTRATIVE GUIDELINES ON FACULTY EXTERNAL ENGAGEMENTS

    Although the University recognizes the benefits of external engagements to the faculty and the University, these external engagements must be entered into by the faculty in accordance with these general guidelines:

    • 8.3.1 Consultancy Work / Services

      9.3.1.1

      No member of the academic staff, officer, or employee of the University may, without prior permission from the Chancellor, practice any profession or engage in consultancy work/services, which in any way may be affected by the functions of the office. Academic staff may not also be directly financially interested in any contract with the University unless permitted by the Board of Regents. [The Revised Code of the University of the Philippines (1961), Art. 250]

      9.3.1.2

      Engagement in consultancy work/services must be endorsed by the Dean, Director, or head of office concerned, subject to the exigencies of service. [987th UP BOR Meeting (24 April 1986)]

      9.3.1.3

      The faculty member/staff requesting permission to undertake consultancy work should state the following in the application: [1031st UP BOR Meeting (28 June 1990)] 

       

      (a) exact nature of the proposed consultancy work/service,

      (b) amount of time to be spent, and

      (c) reasons for pursuing these activities.

      9.3.1.4

      The Department Chair or office head concerned will see to it that a faculty or staff member granted permission to engage in consultancy work/services or in any other outside activity continues to discharge faithfully their duties as a faculty or staff member of the University, and that conditions on prior authorization specified above are complied with.       9.3.1.5

      At the end of the period during which the faculty was granted permission for consultancy work/services, the faculty submits a written report to the Chancellor, through channels. Moreover, request for renewal is not processed without a report on the past year’s outside activities. [1031st UP BOR Meeting (28 June 1990)]

      9.3.1.6

      Consultancy work/services are not conducted on official time. They are subject to such other requirements as may be imposed by law or University rules and regulations. [1031st UP BOR Meeting (28 June 1990)]

      9.3.1.7

      Violation of the provisions on outside activities or external engagements is punishable by reprimand, suspension, or dismissal from service. [The Revised Code of the University of the Philippines (1961), Art. 250; 1031st UP BOR Meeting (28 June 1990)]

    • 8.3.2 Limited Practice of Profession

      9.3.2.1

      The privilege of private practice, when granted, is for a definite period of one (1) year, renewable at the discretion of the Chancellors for one-year periods, and under such conditions as may be prescribed by her/him regarding the nature of the work, the time of performance, and other circumstances. [The Revised Code of the University of the Philippines (1961), Art. 253, as amended at the 839th UP BOR Meeting (29 November 1973) and (1031stUP BOR Meeting (28 June 1990)]

      9.3.2.2

      The grant of authorization for limited practice of one’s profession is governed by these guidelines:

      9.3.2.2.1

      No member of the academic staff, officer, or employee of the University may, without prior permission from the Chancellor, practice any profession or manage personally any private enterprise which in any way may be affected by the functions of office. Further, the academic staff may not be directly financially interested in any contract with the University unless permitted by the Board of Regents. Violation of this provision is punishable by reprimand, suspension, or dismissal from service. [The Revised Code of the University of the Philippines (1961), Art. 250, as amended at the 987th UP BOR Meeting (24 April 1986) and 1031st UP BOR Meeting (28 June 1990)]

      9.3.2.2.2

      Permission to engage in private practice of profession may be granted provided that such practice: [987th UP BOR Meeting (24 April 1986)]

       

      (a)        is not adverse to the interests of the University;

      (b)       shall not be conducted on official time;

      (c)          will improve the person’s efficiency and usefulness to the University; and

      (d)         shall be subject to such other requirements as may be imposed by law or University rules and regulations.

      9.3.2.2.3

      The Faculty member/staff requesting permission states the following in the application: [1031st UP BOR Meeting (28 June 1990)]

       

      (a)          exact nature of the proposed limited practice of profession;

      (b)         amount of time to be spent; and

      (c)          reasons for pursuing these outside activities.

      9.3.2.2.4

      The Department Chair or office head concerned sees to it that a faculty or staff member granted permission to engage in limited practice of profession or in any other outside activity continues to discharge faithfully the duties as a faculty or staff member of the University, and that conditions on prior authorization specified above are complied with.       9.3.2.2.5

      At the end of the period during which the faculty was granted permission for limited practice of profession, a written report on the practice of profession/ management of private enterprise is submitted to the Chancellor, through channels.     • 8.3.3 Commissioned Research and Creative Work for an Outside Agency or Organization

      9.3.3.1

      Before undertaking any research or creative work under the auspices of an organization outside of the University, a faculty member must obtain the consent of the proper Division or Department Chair, Dean or Director, and of the Chancellor. When the research or creative work is to be published, UP should be credited, side by side with the outside organization. [The Revised Code of the University of the Philippines (1961), Art. 262]

      9.3.3.2

      Faculty members can opt to have their externally supported projects administered by the OVCRD. A Memorandum of Agreement (MOA) is required between the funding agency and the University. [OVCRD (2008), Handbook for Researchers, p. 32]

      9.3.3.3

      The administration of commissioned research and creative work coursed through the University is governed by these guidelines:

      9.3.3.3.1

      The OVCRD, through its Project Management Office (PMO), manages funds of projects supported by non-UP funds, government or private. These external funds are managed in the same manner as OVCRD funds except when specified otherwise by the funding agency. [OVCRD (2008), Handbook for Researchers, p. 32]

      9.3.3.3.2

      In accordance with UP policies and guidelines, a percentage of all project funds is allocated for University administrative overhead costs based on approved schedules and governed by the UP System guidelines. [980th UP BOR Meeting (29 August 1985), as amended at the 1037th UP BOR Meeting (31 January 1991) and 1147th UP BOR Meeting (21 December 2000)] University administrative overhead fund refers to the fund maintained by the administration derived from its share of the administrative overhead cost charged against externally funded researches/ projects/ programs.

      9.3.3.3.3

      The University, as a matter of policy, charges externally funded researches/projects/programs of University units or its constituents an administrative overhead cost for the following considerations:

       

      (a)       The use of the UP name and the honor attached to it, and

      (b)      The use of University resources and facilities – personnel, library, laboratories, utilities, etc.

      (Refer to Policy and Guidelines on the Use of University Administrative Overhead Funds, approved at the 980th UP BOR Meeting, 29 August 1985, as amended at the 1037th UP BOR Meeting, 31 January 1991 and 1147th UP BOR meeting, 21 December 2000).

      9.3.3.4

      Intellectual Property Rights of externally funded research and creative work are governed by these guidelines:

      9.3.3.4.1

      All University contracts for research and the production of creative works, regardless of source of funding, should include provisions for ownership of intellectual property rights and resulting tangible materials, means for the determination of authorship as well as processes for settling disputes on authorship or inventorship.       9.3.3.4.2

      In case of an absence of any contractual stipulation to the contrary, if the work (research output, invention, or creative work output) is a result of collaborative efforts between the University, an outside entity and the creator/s, the copyright, or patent, and other related rights are jointly owned by the University, the creators and the outside entity.       9.3.3.4.3

      Subject to the provisions of the Technology Transfer Act of 2009, in the event that funding for the research and creation of the invention is sourced by the University, wholly or partially, from outside entities, the University negotiates with the funding entity with respect to the ownership of the invention, patent rights and royalty sharing subject to confirmation by the Board of Regents.

       

      (a)    The agreement binds all parties including the inventors.

      (b)   In case of default on a negotiated agreement, all patents to inventions that used research funds sourced from or by the University are owned by the University.     • 8.3.4 Teaching in Other Educational or Training Institutions

      No member of the faculty on full-time employment status may engage in teaching outside of the University, unless so authorized under a memorandum of agreement duly entered into with another educational institution. [The Revised Code of the University of the Philippines (1961), Art. 254, as amended at the 793rd UP BOR Meeting (07 April 1970) and 842nd UP BOR Meeting (28 February 1974)]

      In exceptional cases, the President or the Chancellor, as the case may be, may grant permission to faculty members to teach in another institution, even in the absence of an institution-to-institution agreement between the University and the other institution. [The Revised Code of the University of the Philippines (1961), Art. 254, as amended at the 793rd UP BOR Meeting (07 April 1970) and 842nd UP BOR Meeting (28 February 1974)]

      As part of outside activities, teaching in other educational institutions is not considered an integral function of the University and shall not be considered a part of the regular workload of the personnel concerned. [987th BOR meeting, 24 April 1986]

      9.3.4.1

      Rules. Teaching in another university is subject to the following rules: [1168th BOR meeting, 27 February 2003]

       

      9.3.4.1.1

      The other university must be recognized by UP by means of a memorandum of agreement.

      9.3.4.1.2

      The faculty member or academic staff may teach in that university only with specific authorization from the Office of the Chancellor.

      9.3.4.1.3

      Such authorization requires the prior concurrence of the Dean and the Department Chair, Institute Director or division head concerned, and the written consent of the faculty member or academic staff whose services are being requested.

      9.3.4.1.4

      In evaluating the request for a faculty member to teach in another university, administrators will consider the needs of the unit, the current level of the faculty member’s responsibilities to the department and unit and the faculty's overall load (teaching, research and, where applicable, extension).

      9.3.4.1.5

      The authorization, whether original or renewal, is for a period not exceeding one (1) semester at a time, provided the length of service does not go beyond the term of the Memorandum of Agreement.

      9.3.4.1.6

      The request to teach in another university shall be made at least ninety (90) days before the start of the semester when the teaching is to take place.

      9.3.4.1.7

      Department chairs/Institute directors/division heads are furnished copies of all communications between UP (at the level of the Dean and the Chancellor) and the other university regarding their faculty member(s) or academic staff whose services are being requested.

      9.3.4.1.8

      The maximum permissible outside teaching load is six (6) units a semester, provided the total faculty load (teaching, research, and extension, if any), including courses taught outside UP, does not exceed 21 units a semester.

      9.3.4.1.9

      Faculty members with study load, on fellowship or who are enrolled in graduate programs, including those preparing for comprehensive examinations or at the thesis/ dissertation stage, may not teach outside UP.

      9.3.4.1.10

      Faculty members who submit grades late or are habitually absent for student consultation may not be allowed to teach outside UP.

      9.3.4.1.11

      Faculty administrators may not teach outside UP.

      9.3.4.1.12

      Teaching hours in another university should fall outside the unit’s regular office hours, provided exceptions may be made by the Chancellor in meritorious cases.

      9.3.4.1.13

      Faculty members and academic personnel teaching in another university may not in any manner and capacity assume any administrative function or position in the other university.

      9.3.4.1.14

      Teaching outside UP may not be used as a reason to beg off from committee or other assignments, attendance at meetings, and more generally from the responsibilities as UP faculty members or REPS. Neither may outside teaching commitments be used to justify failure or inability to undertake or complete research and other academic projects.

      9.3.4.1.15

      A faculty member or staff who teaches in another university is liable to that university for any infraction of the latter’s rules and regulations committed while teaching in the other university.

      9.3.4.1.16

      A faculty member or staff who violates any of these rules is subject to disciplinary action.

       

      9.3.4.2

      Procedure. Requests (initial or renewal) by another university for the teaching services of UP faculty members or academic personnel are processed in the following manner: [1168th UP BOR Meeting (27 February 2003)]

       

      9.3.4.2.1

      The President of the other university addresses the request for the services of UP faculty or academic staff to the Chancellor specifying, among others, the following:

       

      (a)    Name and unit of the faculty member or academic staff whose services are sought;

      (b)   Nature of projected assignment or involvement, including course title and number of units;

      (c)    Projected service hours; and

      (d)   Approximate duration of assignment.

      9.3.4.2.2

      The request is submitted at least ninety (90) days in advance of the semester.

      9.3.4.2.3

      The Department Chair, Institute Director or Division Head evaluates the request and (a) endorses it to the Dean together with the written consent of the faculty member or academic staff concerned; or (b) finding that the services of the faculty member or academic staff cannot be made available, communicates directly with the other university. In the latter case, the Chair need not forward the request to the Dean.

      9.3.4.2.4

      The Dean either (a) endorses the request to the Chancellor, or (b) finding that the services of the faculty member or academic staff cannot be made available, communicates directly with the other university. In the case of the latter, the Dean need not forward the request to the Chancellor. The Dean, however, informs the Department Chair and the faculty member concerned.

      9.3.4.2.5

      The Chancellor approves or disapproves the Dean’s recommendation and informs the other university as well as the Dean and department Chair of his/her decision in writing.

         

       

       

    • 8.3.5 Management of Private Enterprise

      Permission to engage in management of a private enterprise shall be subject to the conditions imposed on practice of profession. [987th UP BOR Meeting (24 April 1986)] (See Section 9.3.2 above)

    • 8.3.6 Engagement in Professional Organizations and Associations

      In joining professional organizations and associations, faculty members are expected to comply with the following guidelines: [OVPA Memorandum No. 31 (28 March 2001)]

      9.3.6.1

      Individual membership/ application fees to these organizations will not be charged against the funds of the office.

      9.3.6.2

      Office supplies, equipment, and utilities will not be used to promote the organization.

      9.3.6.3

      Attendance in meetings/conferences of these organizations especially during office hours should have the permission of the head of office/immediate supervisor. 

      9.3.6.4

      Attendance in conferences and travels/visits abroad should, as much as possible, be rotated among members of the same organization in the unit.

      9.3.6.5

      When co-organizing conferences/seminars/trainings and similar activities with professional associations and outside organizations, a faculty member must  inform and obtain the consent of the appropriate University authority, especially in cases of use of University resources.

    • 8.3.7 Student Participation in Faculty Members’ External Engagements

      9.3.7.1

      No member of the faculty shall have dealings with any student involving money, property, or other valuable consideration, which might have an influence on the scholastic standing of such student in the University System.       9.3.7.2

      Faculty members are barred from requesting and/or employing students to participate in their projects that they acquired through independent means as a professional in their field, as this may pose a conflict of interest.
